Terms and Conditions of Use

Surviving to Thriving Group Coaching Program

By signing the coaching contract and clicking the "Purchase" button, you as the client of Surviving to Thriving, whether through purchasing online or opting in via an early enrollment option (hereinafter "you" or "Client"), agree and willingly purchase entry into this program to be provided with services rendered by Asha Coaching & Consulting (hereinafter "Asha Coaching" or "Company"), and you agree you are voluntarily entering into a legally binding Agreement with Asha Coaching, inclusive of the following terms and conditions mutually agreed upon:

For good and valuable consideration as outlined below, the receipt and sufficiency of which is hereby acknowledged by all parties, Client is electing to purchase access to "Surviving to Thriving." In exchange, Asha Coaching agrees to provide the services outlined in the Program Overview below.

1. PROGRAM OVERVIEW

A.)" Surviving to Thriving" is an educational and coaching program designed to help late-diagnosed adults (ages 18+) with ADHD gain a deeper understanding of their neurobiology, enhance their executive functioning skills, and develop effective strategies to navigate their unique challenges. This program is an eight (8) week group coaching program, which includes structured lessons, live group coaching, workbooks, access to a private, supportive community, and resources to support learning and implementation.

B.) Client acknowledges that they have read the Program Overview and conducted any additional research necessary to feel they understand what is being provided in "Surviving to Thriving" as well as what is not included. Client agrees to be bound by the terms and conditions outlined herein, as well as the general policies and procedures that can be found in this Agreement and on Asha Coaching's website. 

C.) Participation in the program does not establish a doctor-patient, therapist-client, or any legally protected healthcare relationship between Client and the Company. While Asha Coaching & Consulting is owned and operated by a Licensed Psychologist, this program is not mental health treatment. The Client understands that Asha Coaching & Consulting provides coaching services only and that the Company is acting as an ADHD and executive coach, not as a therapist. This program is not a substitute for therapy, medical treatment, or ADHD medication management, and does not claim to cure or treat ADHD or any other mental health condition. Clients are encouraged to seek professional mental health services if they require therapy or medical care.

D.) At Asha Coaching & Consulting, we are committed to fostering an inclusive, neurodiversity-affirming, and accepting space where all individuals are welcomed and respected. Our core values center around embracing differences, celebrating strengths, and providing a supportive environment for all participants. We do not tolerate discrimination, harassment, or exclusionary behavior of any kind, including but not limited to discrimination based on neurodivergence, race, ethnicity, gender identity, sexual orientation, disability, religion, or any other protected characteristic. Any violations of this policy may result in removal from the program without a refund.

2. PAYMENT & PAYMENT PLANS

A.) The full investment for Surviving to Thriving is $1,497 (one-time payment).

B.) Clients may opt into one of the following payment plans, which include a small administrative fee:

  • 2-Payment Plan: $807 per payment (total: $1,614)

  • 4-Payment Plan: $427 per payment (total: $1,708)

C.) If selecting a payment plan, Client agrees to make all payments as scheduled, with the first payment due upon enrollment and subsequent payments automatically charged on the same calendar day each month, utilizing the same mode of payment as the initial transaction.

D.) If a payment is not successfully processed, Client has a 6-day grace period to resolve the issue. If payment is not received within this period, access to the program will be revoked, and a $200 late fee will be applied if payment is not made after the grace period.

E.) Payment in full is required regardless of Client's use, satisfaction with the program, or results. Client’s decision to cease participation in Surviving to Thriving does not eliminate their responsibility to complete all agreed-upon payments as part of their payment plan.

F.) Program End Date & Payment Obligations: Although the program content and coaching services conclude after eight (8) weeks, clients remain responsible for making all payments as outlined in their selected payment plan. Non-payment or repeated failed payments may result in legal action or collection efforts.

3. REFUND POLICY

A.) Asha Coaching & Consulting wholly believes in the value of Surviving to Thriving and the effectiveness of its methods when the Client is committed to the process. Nevertheless, Asha Coaching & Consulting offers a conditional 15-day money-back guarantee if the Client has completed the work to date and does not believe the information provided is suitable for them. If the Client is not completely satisfied with their purchase of Surviving to Thriving within the first fifteen (15) days after purchase, they may contact the support team at hello@asha-coaching.com prior to 11:59 pm CST on the fifteenth day after purchase.

B.) In their refund request email, the Client must provide (1) the email address used to purchase Surviving to Thriving, and (2) copies of all completed work within the program, demonstrating a good-faith effort before deciding it was not the right fit. Additionally, clients must demonstrate that they attended all course/coaching calls and/or watched replays of the calls. All refund requests will be reviewed and decided solely at the discretion of Asha Coaching & Consulting. If a refund is granted, the Client can expect reimbursement within fifteen (15) days after cancellation in the same manner in which payment was made. If a refund is not granted, the Client understands they remain financially responsible for payment in full and have no further recourse regarding refunds.

C.) Following this fifteen (15) day window, all sales will be considered final. Clients remain responsible for the full payment of all program fees, whether or not they complete the program. If a Client purchased the program with a payment plan, all payments must be made regardless of participation level.

D.) Since we have a clear and explicit refund policy in these Terms of Use that you have agreed to prior to completing the purchase of the program, we do not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company or payment processor.

E.) If a chargeback is placed on a purchase or we receive a chargeback threat during or after your purchase, we reserve the right to report the incident to all three credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account, which could have a negative impact on your credit report score. The information reported will include your name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.

4. VOLUNTARY PARTICIPATION

A.) Client understands and agrees that they are voluntarily choosing to enroll in Surviving to Thriving and are solely responsible for any outcomes or results. While Asha Coaching & Consulting believes in the effectiveness of its services and coaching methodology, the Client acknowledges that Asha Coaching & Consulting is not responsible or liable for any outcomes resulting from their participation. This includes but is not limited to any emotional, physical, mental, or financial impacts. Client is fully responsible for their health and well-being, and for the choices they make during and after the program. Any decisions to implement strategies, tools, and coaching insights are at the Client’s discretion and responsibility.

B.) Client Behavior & Community Conduct: While Clients are welcome to share honest feedback and experiences, any false, defamatory, or disparaging comments made within the program’s community platform(s), social media accounts, or public forums about Surviving to Thriving, Asha Coaching & Consulting, or its team members may result in removal from the program without a refund. This includes content deemed harmful, disruptive, or disrespectful to other participants or the integrity of the program. Asha Coaching & Consulting is committed to fostering a safe and supportive environment and reserves the right to take action to protect the community if this standard is violated

5. CONFIDENTIALITY AND SAFE SPACE COMMITMENT

The coaching relationship is built on trust, and Client acknowledges that Surviving to Thriving is a space for open and honest discussions. To maintain a respectful and safe environment, Client agrees to keep all information shared within group coaching sessions, community spaces, and discussions strictly confidential and will not disclose or share details about other participants or their experiences outside of the program. This includes but is not limited to personal stories, insights shared by peers, and any sensitive topics discussed in coaching calls or community spaces. While reflecting on and discussing personal coaching experiences with trusted friends or colleagues can be beneficial, Client agrees not to share identifying details of others in the group.

 As a Licensed Psychologist, the owner of Asha Coaching & Consulting is committed to protecting the privacy of our conversations. Everything discussed in coaching remains confidential, with only a few exceptions required by law as a mandated reporter. If Asha Coaching & Consulting becomes aware of a situation where someone is at immediate risk of harm—such as in cases of abuse involving a child, elderly, or disabled person, or if the Client expresses imminent danger to themselves or others—the Company is legally required to report this to the appropriate authorities. These situations are rare in a coaching setting, and if they ever arise, every effort will be made to discuss them with the Client before taking action if possible or appropriate.

Additionally, Asha Coaching & Consulting acknowledges the limitations of electronic communication. While precautions are taken to protect the security of interactions, email and virtual platforms are not 100% secure. If the Client has concerns about privacy, alternative methods of communication can be discussed. By working together, the Client acknowledges these potential risks and agrees to use electronic communication with this understanding. The goal is to create a space where all participants feel safe, respected, and fully supported. 

C.) Non-Disclosure & Intellectual Property Protection: By enrolling in this program, Client gains access to confidential and proprietary information, including but not limited to coaching methodologies, strategies, worksheets, templates, recorded sessions, technical insights, and business practices that have been uniquely developed by Asha Coaching & Consulting. Client agrees not to share, copy, distribute, or repurpose any documents, proprietary strategies, or other intellectual property obtained through Surviving to Thriving without express written permission from Asha Coaching & Consulting. Use of program materials in any business, coaching, or professional service without prior authorization is strictly prohibited.

D.) Client Behavior & Community Conduct: Asha Coaching & Consulting is committed to maintaining a respectful, inclusive, and constructive community for all participants. While Client is encouraged to share their opinions and experiences, harassment, disruptive behavior, false or disparaging statements made within the program’s community platforms, on social media, or in any public forums regarding Surviving to Thriving, Asha Coaching & Consulting, or its team members may result in removal from the program without a refund. Clients found violating this expectation may be subject to warnings, removal from community spaces, or full termination from the program at the discretion of Asha Coaching & Consulting.

E.) Ethical Participation Agreement: Asha Coaching & Consulting values community, learning, and professional integrity. To maintain a safe and positive environment, Client agrees to communicate in a manner that is respectful, professional, and free from harmful language. Any breaches of confidentiality, intellectual property misuse, or disruptive behavior will be considered a violation of this Agreement and may result in immediate removal from the program without a refund.

6. DISCLAIMER

A.) Asha Coaching & Consulting cannot guarantee specific results from participating in Surviving to Thriving and makes no representations or guarantees regarding individual outcomes. Client acknowledges that results may vary based on personal effort, engagement, and external factors. Client agrees to hold Asha Coaching & Consulting harmless if they do not experience the desired progress, including but not limited to improvements in executive functioning, time management, or overall well-being.

B.) Earnings & Professional Disclaimer: Asha Coaching & Consulting does not make any guarantees regarding financial or career-related outcomes resulting from participation in Surviving to Thriving. While strategies and frameworks may support professional and business growth, Client acknowledges that individual financial success or professional advancement is solely their responsibility. Any testimonials or success stories shared by Asha Coaching & Consulting reflect personal experiences of past clients and are not guarantees of expected results.

C.) All services provided in connection with this program are offered on an "as-is" basis, without warranties of any kind, express or implied. This includes but is not limited to warranties regarding fitness for a particular purpose, merchantability, non-infringement, or expected performance. Client understands that Asha Coaching & Consulting does not guarantee that the program will meet their specific needs or expectations.

D.) Client agrees that they do not have a cause of action, legal remedy, or refund entitlement should they not achieve their desired results, as long as Asha Coaching & Consulting delivers the program as described in Section 1 (Program Overview) or provides equivalent substitutions.

E.) Client agrees to hold Asha Coaching & Consulting harmless from any physical, emotional, or financial injury occurring as a direct or indirect result of participating in Surviving to Thriving. The program's content is based on research, lived experience, and professional expertise but may not be applicable to every individual’s unique situation. Client acknowledges that they are responsible for their personal choices, actions, and well-being throughout the coaching process.

7. INTELLECTUAL PROPERTY

A.) All content provided in the Surviving to Thriving program—including but not limited to videos, worksheets, coaching frameworks, slide decks, templates, call recordings, handouts, digital downloads, written materials, program design, and live sessions—is the exclusive intellectual property of Asha Coaching & Consulting and/or its affiliates or licensors (hereinafter “Content”). These materials are protected by U.S. copyright, trademark, and other intellectual property laws.

B.) Upon enrollment, Client is granted a limited, revocable, non-transferable license to access and use the Content for their personal use only. This license does not grant any ownership rights. Client may not republish, reproduce, duplicate, copy, modify, share, sell, license, sublicense, upload, post, transmit, or distribute any Content without the express written consent of Asha Coaching & Consulting.

C.) Client agrees not to use any Content for commercial purposes, to develop a competing program, or in any way that earns them or a third party money based on Asha Coaching’s intellectual property. Any such use constitutes a material breach of this agreement and may result in legal action, removal from the program without refund, and financial liability for damages incurred.

D.) Unauthorized use or reproduction of any Content will be treated as intellectual property theft. Asha Coaching & Consulting reserves the right to pursue all legal remedies, including injunctive relief and monetary damages.

E.) Your License to Asha Coaching; Your Likeness in Testimonials and Marketing:
By posting or submitting any material during the Program—such as comments, posts, photos, graphics, images, designs, videos, or other contributions—you represent that you are the rightful owner of all such materials and are at least eighteen (18) years old. Asha Coaching & Consulting may request your written consent to use your likeness (including your name, screen name, image, or voice), comments, posts, or other contributions for commercial purposes, such as marketing or advertising.

If you grant such consent, you agree that Asha Coaching & Consulting and its authorized affiliates will be granted a non-exclusive, irrevocable, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works based on your contributions, in any format or media now known or developed in the future. This license includes the right to include your contributions in current or future offerings, materials, or digital content.

F) Community Contributions & Testimonials
Client understands and agrees that any commentary shared within the private coaching community (hosted on Circle.so), in Zoom chat, via email, or through a feedback or testimonial form may be used by Asha Coaching & Consulting for the purpose of marketing or showcasing client experiences. This includes non-confidential reflections, written posts, feedback shared in group discussions, and publicly posted praise.

By participating in the community, Client grants Asha Coaching & Consulting a non-exclusive, royalty-free, perpetual, irrevocable license to use such contributions—including written quotes, screenshots, or excerpts—on social media, in promotional materials, or on the website for the purpose of highlighting the impact of the Surviving to Thriving program.

Asha Coaching & Consulting will never use your full name, photo, or any identifying details without first requesting your written consent. We respect your privacy and will make every reasonable effort to anonymize personal information unless explicit permission has been granted.

G.) Program Recordings and Peer Access:
Client acknowledges and agrees that all group coaching sessions, workshops, Q&A calls, and live community events will be recorded by Asha Coaching & Consulting. These recordings will be made available to current program participants for review and continued learning. By participating in these sessions, Client consents to being recorded and understands that other members enrolled in Surviving to Thriving may have access to recordings that include their voice, video, and contributions.

While Asha Coaching & Consulting will not publish full recordings for public marketing or distribution without explicit consent, Client acknowledges that these recordings are considered part of the program content and community learning environment. As such, they may be archived and shared internally with future cohorts or alumni within private platforms hosted by Asha Coaching.

If a contribution is to be used for promotional, testimonial, or marketing purposes outside of the program space, Asha Coaching will request separate, explicit permission from the Client before doing so. Reasonable efforts will be made to anonymize identifying information when requested, but complete anonymity cannot be guaranteed due to the nature of interactive group sessions.

H.) Audio-Visual Recording License:
You also grant Asha Coaching & Consulting a license to use audio-visual recordings that may contain your voice, image, or likeness for repurposing, including (but not limited to) private training content, podcast episodes, or promotional materials—provided identifying information is removed. If your name or likeness is to be used, Asha Coaching & Consulting will request separate, explicit consent before doing so.

I.) Reservation of Rights:
All rights not expressly granted under these Terms are reserved by Asha Coaching & Consulting.

8. INDEMNIFICATION

Client agrees at all times to defend, fully indemnify, and hold Asha Coaching & Consulting and any affiliates, agents, team members, or other associated parties harmless from any causes of action, claims, damages, losses, costs, expenses, or liabilities arising from their participation in the program, including any third-party claims. Should Asha Coaching & Consulting be required to defend itself in any matter involving Client, the Client agrees to provide full cooperation, including relevant documents, testimony, or assistance, free of charge.

9. PROGRAM ACCESS

A.) Upon enrollment, Client will receive immediate access to the private Circle.so community for connection and peer support. Course content, including weekly lessons, slides, and reflection exercises, will be released on a dripped schedule, with new content becoming available each week over the 8-week duration of the Surviving to Thriving coaching experience. This structured release format is designed to support steady progress and minimize overwhelm. Curriculum pacing, scheduling of live sessions, and any implementation or break weeks are at the sole discretion of Asha Coaching & Consulting.

B.) Lifetime access is granted to the core course materials available at the time of enrollment, including videos, workbooks, call recordings, and other downloadable resources. This access remains available to Client for as long as the course is hosted by Asha Coaching & Consulting. Lifetime access does not include any future live coaching sessions, updated content, or additional features introduced in future cohorts unless expressly stated. Asha Coaching reserves the right to modify, restructure, or retire elements of the platform or course delivery at its sole discretion, while making reasonable efforts to preserve access to originally promised materials.

10. DISPUTE RESOLUTION

A.) If a dispute arises, Client agrees to first attempt resolution through informal good-faith discussion with Asha Coaching & Consulting.

B.) If unresolved, both parties agree to submit the dispute to binding arbitration through the American Arbitration Association in Minneapolis, Minnesota. The arbitrator’s decision shall be final and binding. This agreement to arbitrate includes the commitment to participate in the process and share materials as needed to reach a resolution. Legal proceedings may not be initiated unless required to enforce the arbitrator’s decision.

11. AMENDMENTS

A.) Asha Coaching & Consulting may update or revise these terms at any time. Any changes will apply to future cohorts only. Clients enrolled in a previous cohort remain subject to the version in effect at the time of their enrollment.

B.) If material changes are made during an active cohort, Asha Coaching will notify participants via the email provided at registration. Continued participation constitutes agreement to updated terms.

12. ARTIFICIAL INTELLIGENCE (AI) DISCLAIMER

A.) Asha Coaching & Consulting may use artificial intelligence (AI) tools to support the development or optimization of certain materials or processes (e.g., written content, graphics, or organizational systems). However, all final content is reviewed and curated by a human expert prior to publication.

B.) Client acknowledges that AI-generated elements, while valuable, may not be 100% accurate or up to date. Client agrees that any reliance on AI-generated content is at their own discretion and risk. Asha Coaching & Consulting is not liable for outcomes related to use or interpretation of AI-supported material.

13. FORCE MAJEURE

Asha Coaching & Consulting shall not be deemed in breach of this Agreement if it is unable to fulfill part or all of the Program due to a “Force Majeure Event,” including but not limited to acts of God, fire, flood, war, governmental order, labor dispute, pandemic, epidemic, illness or incapacity of Company personnel, or any other circumstance beyond its control. In such an event, Asha Coaching will notify the Client of any delays or interruptions and may propose alternative timelines or methods for delivering the Program. In some cases, the Company reserves the right to cancel or terminate the Program without penalty.

14. GENERAL PROVISIONS

A.) Asha Coaching & Consulting may modify these Terms of Use at any time. Any updates will be posted on the Company website and, if applicable, shared via email with current participants. Continued use of the Program constitutes acceptance of the revised terms.

B.) If any provision of this Agreement is held invalid or unenforceable, the remainder shall remain in full force and effect. That provision shall be replaced with a valid and enforceable term that most closely reflects the intent of the original.

C.) This Agreement constitutes the entire understanding between the parties and supersedes any prior verbal or written agreements relating to the Program.

D.) By checking the box and completing purchase, Client confirms that they have read, understood, and agreed to all terms outlined in this document. This action constitutes a legally binding electronic signature. If you do not agree to these Terms of Use, you should not enroll in or access the Program.
